General Terms and Conditions for the Rental of Power Banks (Power Bank Sharing)

Last updated: October 2026

§ 1 Lessor and scope

(1) The lessor is MA S. Solutions UG (haftungsbeschränkt), Am Brauhaus 4, 91413 Neustadt a. d. Aisch, Germany, represented by its managing director Arthur Reiz, Local Court (Amtsgericht) Fürth HRB 22805, phone/WhatsApp +49 179 4382414, email info@ma-solutions.ch (“we”).

(2) These terms apply to all contracts for the rental of power banks at our stations. The stations are located at partner venues (e.g. clubs and bars). Your contractual partner is exclusively MA S. Solutions UG, not the respective partner venue.

(3) Every station refers to these terms by means of a clearly visible notice with a QR code. These terms apply when you rent a power bank.

§ 2 Conclusion of contract and start of rental

(1) The station offers available power banks for rent. You accept the offer by holding your payment card, or your smartphone or smartwatch with a stored card, to the station's terminal and authorising the payment.

(2) The rental contract is concluded as soon as the station releases a power bank. The rental period begins when the power bank is released.

(3) If the station does not release a power bank, no contract is concluded and nothing is charged; any reservation already made is released.

(4) Rental is restricted to persons of legal age.

§ 3 Prices

(1) The prices displayed at the station apply. Currently:

  • Return within 2 minutes of release: free of charge
  • first hour: €2.90
  • each additional started hour: €1.50
  • maximum per 24 hours: €12.00

(2) No more than €25.00 in total is charged per rental (see § 5 (3)).

(3) All prices are final prices in euros including statutory VAT.

§ 4 Deposit (reservation) and payment

(1) At the start of the rental, an amount of €25.00 is reserved (authorised) on your means of payment, but not charged.

(2) After the return, only the rental fee actually incurred is charged; the remaining amount is released. When the release becomes visible on your account depends on your bank.

(3) Payments are processed by the payment service provider Stripe Payments Europe, Ltd., Dublin, Ireland.

(4) You ensure that your means of payment is valid and has sufficient funds.

§ 5 Return, maximum rental period, non-return

(1) You can return the power bank to a free slot at any of our stations (overview: ma-solutions.ch/en/powerbank#standorte). The rental ends as soon as the station has registered the return.

(2) The stations are located at partner venues and are only accessible during their opening hours; some locations (e.g. clubs) are only open on certain days. Please take this into account when renting.

(3) The maximum rental period is 46 hours. If you do not return the power bank within 46 hours, we charge a one-off flat fee of €25.00 (including the rental fee incurred up to that point); the power bank then becomes your property. You remain entitled to prove that we have suffered no damage or significantly less damage.

(4) If a station is full or out of order, return the power bank at another station or contact us (§ 8). We do not charge for periods in which a return was demonstrably not possible for reasons for which we are responsible.

§ 6 Your obligations

(1) Handle the power bank with care and protect it from moisture, heat (e.g. in a car in the sun), falls and damage.

(2) Opening, tampering with or short-circuiting the power bank and sub-letting it are prohibited.

(3) A damaged, unusually hot or swollen power bank must no longer be used. Please report damage and malfunctions without delay (§ 8).

§ 7 Liability

(1) You are liable for damage to or loss of the power bank caused through your fault, but up to a maximum of €25.00. You are not liable for normal wear and tear.

(2) We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the typical, foreseeable damage; otherwise, liability for slight negligence is excluded.

(3) There is no entitlement to power banks or free return slots being available at a particular station at all times.

§ 8 Customer service

For questions, malfunctions or complaints, you can reach us via WhatsApp or phone at +49 179 4382414 or by email at info@ma-solutions.ch. The staff of the partner venues are not responsible for this. Please state the location and the date and time of the rental. We refund unjustified charges promptly.

§ 9 No right of withdrawal

The rental contract is concluded at a station (vending machine). There is no statutory right of withdrawal for such contracts (§ 312 (2) No. 9 German Civil Code, BGB). You can end the rental at any time by returning the power bank; only the rental time incurred up to that point is charged.

§ 10 Data protection

Information on how your data is processed can be found in our privacy notice for the power bank rental at ma-solutions.ch/en/powerbank#datenschutz.

§ 11 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of the country of your habitual residence remain unaffected.

(2) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.

The German version is legally binding.
